RENTAL AGREEMENT BETWEEN GUEST AND PROPERTY OWNER
The Rental Agreement constitutes a binding Agreement between the Guest and the Property Owner, for which Florida Keys Rental Store is acting as Agent, to rent the premises described on the first page of this Rental Agreement, only upon the written approval by the Property Owner.
Guest understands and agrees:
RESERVATIONS: A security/damage deposit is required to confirm and hold all reservations. Reservations can be competitive and are first come, first serve, based on the deposit being received with the sign reservation agreements. Fifty percent (50%) of the total reservation charges (not including security deposit) are due within thirty (30) days of the “Reservation Confirmation.” Full payment is due sixty (60) days prior to arrival. If reservations are made within sixty (60) days of arrival, payment in full is due at the time of reservation. Deposits may be paid with personal checks if received at least fourteen (14) days prior to the required payment date. Payments MUST be made in the form of cash, cashiers/travelers checks, money order, or credit card (MC, VISA, DISCOVER).
CANCELLATION POLICY: Notice of cancellation MUST be submitted in writing. Notice given over the telephone will not be considered valid, and will NOT be accepted. All cancellations are subject to a ten percent (10%) cancellation fee. Written notification received 61 days prior to occupancy: Ninety percent (90%) refund of the total rental cost. NO REFUNDS on any cancellation made sixty (60) days or less prior to occupancy. If FKRS is able to successfully book another tenant into your canceled property/time slot, then a full refund will be issued minus the ten percent (10%) cancellation fee.
SALES TAX: A 12.5% Florida and Monroe County combined sales tax is collected on all rentals less than six (6) months.
OCCUPANCY: The Guest agrees to peaceably and quietly use and occupy their rental property and agrees not to commit waste and not make any unlawful or offensive use of the rental property during occupancy. Occupancy may not exceed the number of persons indicated on the Rental Agreement. Any occupancy over the amount indicated will result in immediate eviction and FORFEITURE OF ALL RENT! No overnight visitors will be permitted without the primary lessee present at the property. HOUSE PARTIES ARE STRICTLY PROHIBITED. Fire of any kind is strictly prohibited on the property.
KEYS AND/OR GATE CARDS: The Guest acknowledges all keys and/or gate cards are to be picked up at FKRS office upon arrival for Check-In. All keys and/or gate cards must be returned to FKRS office upon departure for checkout. If keys and gate cards are not returned a fee of $100 per key/card will be deducted from your security deposit.
PETS: If a pet is allowed you will incur a $250 refundable pet fee. There are restrictions on the number and type of pets allowed. PETS FOUND IN A NO-PET PROPERTY will result in IMMEDIATE EVICTION, a $250 fine and FORFEITURE OF ALL RENT MONIES! Declare all pets when making your reservation to avoid eviction.
CHECK-IN TIME: From 4 p.m. Check-in packages will be in our drop box located in front of the FKRS office at MM 100 bayside in Key Largo, Florida. FKRS is co-located with American Caribbean Real Estate 99900 Overseas Hwy, Key Largo, FL 33037
CHECKOUT TIME: 10 a.m. SHARP! Our housekeeping staff will be at your door to prepare the property for the next arrival. Failure to meet the scheduled checkout time will result in a late checkout charge or an additional pro-rated charge for tenancy.
DEPARTURE CLEANING FEE: A departure-cleaning fee is required on all rentals. Anything left extremely dirty, including carpet or furniture requiring cleaning due to guest carelessness, will be additional and will be deducted from the deposit.
UTILITIES: Rentals less than 28 days do not incur costs for utility usage. Rentals of 28 days or more will be charged for utilities. The guest will pay utility costs by deducting the charges from the security deposit.
TELEPHONE: Most rental properties have telephones. There is typically a block on the phone, which blocks all toll calls.
SUPPLIES: Rental properties are equipped with color cable television, linens, pillows, pots, pans, dinnerware, glassware and flatware. Specialty items will vary at each rental location. Beach towels, detergents and most toiletry items are normally not furnished at the rental property.
DAMAGE: Guest shall be responsible for the costs of any and all damages determined to have been caused by guest, or during guest’s occupancy. Guest’s responsibility shall not be limited to the amount of the security/damage deposit in the event that costs exceed said deposit. To avoid any claims against your deposit or additional charges to your credit card, we ask that you treat the rental property as you would treat your own home.
DAVITS: All properties prohibit the use of davits or boat lifts.
SMOKING: All our rental units are NON-SMOKING. If you smoke inside the unit, you will be charged $300 for ionization and extra cleaning. POOLS: Use at your own risk. NO LIFEGUARD. NO diving permitted.
REPAIRS: FKRS in not responsible for any mechanical failures at the rental property including the breakdown of any appliance or air conditioner units. There will be no refunds for any mechanical, appliance or air conditioning failure. In the event of any problem during your stay, notify FKRS and/or call the property manager immediately. We will make every effort to have necessary repairs made as soon as possible.
RETURN OF SECURITY DEPOSITS: You can expect to receive your security deposit within fifteen (15) days after departure unless there are damages in which case we will have 30 days to acquire repair estimates. If you rent for 28 days or more, we reserve the right to hold deposits for up to sixty (60) days to determine and pay utilities at the rental property. Deposits will be returned in the form they were originally paid, except cash will be returned in check form.
EARLY DEPARTURE: THERE WILL BE NO REFUNDS on any early departures. NO EXCEPTIONS.
BOATS & PERSONAL WATERCRAFT: All boats and/or personal watercraft being brought to, stored on or docked at a rental property require PROOF OF INSURANCE PRIOR TO OCCUPANCY.
OTHER: In the event of an emergency, or should a rental property owner remove his/her property from our inventory, or in the event a rental property owner should sell his/her property and not be available for occupancy, we reserve the right to provide comparable accommodations to the guest of equal or greater value. If the accommodations are not acceptable to the guest, a full refund will be provided.
RENTAL PROPERTY LISTING: If this property is listed for sale, you may be required to allow the property to be shown to prospective buyers during your stay. You will be notified by phone at least 24 hours prior to any showing. Should you be interested in purchasing a vacation property during your stay, please call the property manager.
MANDATORY EVACUATION: In the event that there is a mandatory evacuation due to circumstances beyond our control, return of unused rental funds is at the discretion of the property owner.
NOTICE TO PROSPECTIVE TENANTS: Radon gas is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county health unit. Pursuant to Section 404.056 Florida Statutes, the undersigned acknowledges that this written notice was received before the undersigned signed a contractual offer, in compliance with Section 475.25(1) Florida Statutes and Rule 21V-10.003, Florida Administrative Code.
ACCEPTANCE: By signing this rental agreement the guest declares they have read, understand and agree to abide by the agreement and the Terms and Conditions as outlined.
